Dear respected Shaykh, assalamu alaikum wa rahmatullahi wa barakatuh. Is the fast made up for a sick person who broke his fast and then died four days after the start of Ramadan?

مريض أفطر في رمضان وبعد أربعة أيام من دخول الشهر مات، فهل يُقضى عنه؟

الجواب

Praise be to Allah, and may Allah’s peace and blessings be upon the Messenger of Allah, his family and his companions.   Wa alaikum assalam wa rahmatullahi wa barakatuh.   As to what follows:   In response to your question, we say:       Is the fast made up for a sick person who broke his fast and then died four days after the start of  Ramadan? The rest of the days of Ramadan are not made up in fasting for a sick person who died in Ramadan because he definitely did not live to see these days. If he did not fast the days that he witnessed in Ramadan because of a curable disease then it is not incumbent to make up for these days, because these days are made up for after Ramadan and the dead person did not live to see this time. There is no problem if someone fasts on behalf of this person but it is not compulsory upon anyone to make up for these days or feed poor people  in compensation on behalf of the dead person because his sickness is one in which breaking fast is allowed, and he did not live up to a time where it was possible for him to make up for the missed fasts.   If the deceased died of a chronic illness, then the days that he missed in fasting should not be made up for, rather poor people should be fed on his behalf. This involves feeding a poor person for each day of missed fasting because of Allah’s statement “And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor person [each day]” [al-Baqarah 2: 184]. ‘Abdullah ibn ‘Abbas (may Allah be pleased with him) said, “This verse is not abrogated, rather, it applies to the old man and woman who cannot fast or make up for the missed days. They should break their fast and feed the poor people.” An authentic narration states that when Anas became old he could not withstand fasting and he used to feed a poor person for each missed day of fasting.
