ما حكم من لم يبيت نية الصوم من الليل؟ وهل يلزمه القضاء؟

الجواب
Praise be to Allah, and may Allah’s peace and blessings be upon the Messenger of Allah, his family and his companions. Wa alaikum assalam wa rahmatullahi wa barakatuh. As to what follows: In response to your question, we say: There is no difference of opinion among the scholars that if a person knows of the start of Ramadan during the day he should not engage in any nullifier of fasting for the rest of that day. However, the scholars differed about the status of this fast, whether it is sufficient or the person has to fast another day to make up for this day? The majority of the scholars were of the opinion that it is compulsory to make up for this day, because the person did not make the intention for fasting before dawn, and the Prophet (peace be upon him) said, “Whoever does not have the intention of fasting from the night before, then there is no fast for him” [Sunan an-Nasaai (2334)]. In another hadeeth he stated, “There is no fasting for the person who does not intend to fast the night before.” This shows that a person must make the intention for a compulsory fast at night. Therefore if a person does not make the intention at night, he should make up for that day.
