Is throwing pebbles at Jamrat al-‘Aqaba considered a condition to exit the state of ihram?

Answer

All praise is due to Allah alone, and may the Salah and Salam of Allah be upon our Prophet Muhammad, his family and his companions. To answer your question, we say while seeking all the success from Allah: According to the Maliki Madhab, the minor tahallul (terminating the state of ihram) is due after the throwing of pebbles at the Jamrat al-Aqaba. Thus, if the pilgrim shaves his head before throwing the stones at Jamrat al-‘Aqaba, then they must offer a sacrifice because they shaved before exiting the state of ihram. The same ruling applies if the person did Tawaf al-Idfadah (circumambulation on return from Mina) before throwing the stones. However, in the case of the shaving, one must shave again after throwing whereas in the case of tawaf, it is considered sufficient if one did it before throwing provided that it did not happen out of ignorance, forgetfulness or error. If either of the three was the case, then the pilgrim is not required to sacrifice a sheep. For more details, see Hashiyat al-Kharshi ‘ala Mukhtasar Khalil (2/337) and al-Tamheed of Ibn ‘Abd al-Bar (7/273 and onward) Your brother, Khalid al-Mosleh   16/12/1424
