Question

Respected Shaykh, Assalamu Alaykum wa rahmatullahi wa barakatuhu. What is the ruling of a student who gives her colleagues some of her assignments for them to copy from her?

الغش في الاختبارات والواجبات المدرسية

Answer

All praise is due to Allah. May Allah's peace and blessings be upon our Prophet Muhammad, his family, and all his companions.

To proceed:

The Prophet (peace be upon him) gave a ruling for dealing with each other and he said, "Whoever cheats us is not from us." This covers all types of cheating and deceit which are practiced in the field of education, transactions, marriage and so on. The general understanding is that he who takes what he does not deserve in a devious manner then he will be part of the Prophet's (peace be upon him) statement: "Whoever cheats us is not from us."

There is no difference in this regard on whether the university allows this or it does not allow it. If an issue involves deceit, and a person's pretending that he knows when he does not know, because a person who copies an assignment from someone and presents it as his, he would really be testifying that he has clearly understood the course; then this is not permissible even if the school authorities agree to this.

This includes what is common in these days whereby students get questions before exams. If a person is sure that the students have the questions before hand then he should not let himself have access to them or read them.

However, if a person comes across the questions that are circulated on social media, and it is not certain that these are the questions which will be asked in the examination, then there is no problem if he reads them like he reads any past examination paper with the possibility that a past question could be asked in that year.

However, if it is certain that the questions are the ones which will be asked in the examination, then it is not permissible for him to read them, because this is cheating. However, if there is a possibility, even though it is a small one, that these questions will not be asked in that year, then there is no problem in reading them.

This is similar to a case where a person reads the questions of the past year with the possibility that these questions will be asked again, this person will not be told, "Do not read the questions of the past year because of the possibility that they may be asked again." If a person reads such questions, there is no problem. This is not cheating. And Allah knows best.
